That said, there are three ways an injured worker may be able to recover more compensation than is provided under a standard workersโ€™ compensation claim. You might think that since workersโ€™ compensation is designed as a less adversarial way to provide for injured workers, you wouldnโ€™t have to fight for your benefits. But, that isnโ€™t always trueโ€“especially if youโ€™ve been seriously injured and the amount of money involved is significant. So, youโ€™ll want to start building a record right away.

Youโ€™ll also want to keep a close eye on how your claim is proceeding and make sure to get help if and when you need it. Some signals that itโ€™s time to contact a work injury lawyer include: 

  • Delays in processing or paying benefits on your claim
  • A workersโ€™ comp physician clears you to return to work when you believe you are still medically unable
  • Benefits being lower than you believe you are entitled to
